Agreement to Terms

By downloading, accessing, or using the Focal mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

Description of Service

Focal is a mobile Bible application developed by Qlay Labs, LLC that provides:

- Access to Bible texts and translations

- Reading tracking and personal study tools

- Bookmarking, highlighting, and note-taking features

- Cross-device synchronization of your reading data

- Style packs and themes for different preferences

- Optional support through voluntary recurring contributions
- Potential advanced features for contributors (offline access, audio narration, advanced tools, if developed)

Account Registration

To use certain features, you must create an account by providing:

- A valid email address

- Authentication through Google, Apple, or email/password

You are responsible for:

- Maintaining the security of your account credentials

- All activities that occur under your account

- Immediately notifying us of any unauthorized use

Acceptable Use

You agree to use Focal only for lawful purposes and in accordance with these Terms. You may not:

- Violate any applicable laws or regulations

- Impersonate others or provide false information

- Attempt to gain unauthorized access to our systems

- Interfere with or disrupt the App's functionality

- Use the App for commercial purposes without permission

- Reverse engineer, decompile, or attempt to extract source code

Voluntary Support Contributions

Pay-What-You-Want Model

- Supporting Focal through recurring monthly contributions is entirely voluntary

- You may choose any amount you wish to contribute monthly

- Contributions help us maintain and improve the App
- Contributors may receive access to advanced features as a thank-you benefit, if and when developed

Advanced Features for Contributors

Contributors may gain access to enhanced features, which may include:

- Offline Bible access for reading without internet connection

- Audio narration and text-to-speech functionality

- Advanced study tools and note-taking features

- Early access to new features and style packs

Important Disclaimers:

- Advanced features are planned but not guaranteed to be developed or released

- Contributions should be made to support the App's development, not specifically to receive advanced features

- We reserve the right to modify, delay, or cancel any planned advanced features

- No refunds will be provided if planned advanced features are not developed or released

- The core Bible reading functionality will always remain available regardless of contribution status

Payment Terms

- Contributions are processed through secure third-party payment providers

- You may modify or cancel your contribution at any time through your account settings

- We do not store your payment information directly

- All contributions are final and non-refundable, except as required by law
- Advanced features are available as long as your contribution is active

Cancellation

- You may stop your recurring contribution at any time

- Cancellation takes effect at the end of your current billing period

- Access to any available advanced features will end when your contribution period expires

- Core Bible reading functionality remains available to all users regardless of contribution status

Content and Intellectual Property

Bible Content

- Bible texts are in the public domain or used with appropriate licensing

- We provide attribution for translations and versions as required

Your Content

- You retain ownership of any notes, highlights, or bookmarks you create

- You grant us a license to store and sync this content across your devices

- You may export or delete your content at any time

Our Content

- The Focal app, including its design, features, and original content, is our intellectual property

- You may not copy, modify, or redistribute our proprietary content

Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Service Availability

We strive to provide reliable service, but we cannot guarantee:

- Uninterrupted access to the App

- Error-free operation

- Compatibility with all devices or operating systems

We reserve the right to modify, suspend, or discontinue the App with reasonable notice.

Limitation of Liability

To the fullest extent permitted by law:

- Focal is provided "as is" without warranties of any kind

- We are not liable for any indirect, incidental, or consequential damages

- Our total liability is limited to the amount you have paid in contributions in the past 12 months

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Termination

We may terminate or suspend your account if you violate these Terms. You may terminate your account at any time through the App settings.

Upon termination:

- Your access to the App will cease

- We may retain some information as required by law or for legitimate business purposes

- These Terms will continue to apply to any prior use of the App

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use after changes indicates acceptance of the updated Terms.
